TERMS AND CONDITIONS

These Terms apply to workshops, classes, events, memberships, and related activities offered by Lael Gallery & Studios (“the Studio”). By completing checkout or participating, you agree to these Terms.

1. Registration and Payment

Prices, fees, taxes, and included benefits are displayed at checkout. All workshops and events are one-time purchases and do not renew automatically. Some memberships may be offered with an optional recurring-payment plan. If selected, the billing amount, frequency, renewal terms, and cancellation instructions will be clearly disclosed before purchase.

Payment is required to reserve a place. Registration is subject to availability and class-size limits.

Ticket Tailor provides the registration platform but is not the workshop provider. The agreement is between the purchaser and Lael Gallery & Studios. Payments may be processed through Stripe, PayPal, Square, or another payment provider, or payment options, whose separate terms and privacy policies may apply.

2. Membership Benefits

Membership benefits are those displayed at checkout. Benefits:

• Apply only during the stated membership period;

• Require advance registration are subject to availability;

• Are personal, non-transferable, and have no cash value; and

• Expire at the end of the stated membership period unless otherwise stated.

Unused benefits do not roll over or qualify for a refund. Guest passes are subject to availability, registration requirements and Studio policies.

The Studio may reasonably change instructors, schedules, topics, locations, or individual activities.

3. Cancellations and Refunds

Except as required by law, workshop, event, and membership purchases are non-refundable.

Absences, illness, late arrivals, vacations, scheduling conflicts, and unused benefits do not qualify for refunds or prorated payments. The Studio may offer a transfer or credit when sufficient advance notice is provided, but transfers and credits are not guaranteed.

If the Studio cancels a program, it will offer a replacement date, transfer, Studio credit, or refund. The Studio is not responsible for transportation, childcare, independently purchased supplies, or other incidental expenses.

4. Weather and Schedule Changes

The Studio may cancel, combine, relocate, reschedule, or modify a program because of low enrollment, severe weather, wildfire smoke, emergencies, instructor illness, unsafe conditions, or circumstances beyond its reasonable control.

The Studio may substitute instructors or make reasonable changes to program topics, schedules, formats, locations, or materials. Participants will be notified using the contact information provided during registration.

5. Conduct and Politics Free Environment

Participants must treat instructors, students, guests, artwork, equipment, and property respectfully.

Abusive, threatening, discriminatory, harassing, disruptive, unsafe, or seriously confrontational conduct is prohibited. Participants may not attend while visibly impaired, engage in unwanted contact, deliberately damage property, steal, possess weapons, or use tools or materials unsafely.

To maintain an art-focused environment, partisan political debate, campaigning, advocacy, and politically confrontational commentary are not permitted during Studio programs or in online Studio-managed groups. This does not prohibit religious, cultural, or personal identity or respectful discussion directly relevant to art or instruction.

The Studio may redirect inappropriate conversations, require a participant to leave, cancel a registration, or terminate a membership for serious or repeated violations. No refund will be provided when removal results from the participant’s conduct, except as required by law.

6. Safety and Art Materials

Participants must follow instructor directions and product-safety instructions.

Hazardous, unlabeled, strongly toxic, highly flammable, aerosol, or strong-fume materials may not be brought into the Studio without approval.

Participants must keep shared areas and exits clear, use protective equipment when instructed, and report injuries, spills, damaged equipment, or unsafe conditions. Participants should notify the instructor of relevant allergies, sensitivities, medical concerns, or accessibility needs.

The Studio cannot guarantee an allergen-free or chemical-free environment.

7. Cleanup and Personal Property

Students must clean their tools and workspaces before the end of class. Paint and art materials may permanently stain clothing and belongings.

The Studio is not responsible for lost, stolen, stained, misplaced, or damaged personal property. Artwork or supplies may be stored only with permission. Items not collected within 30 days after the final class or pickup notice may be moved, donated, recycled, or discarded.

8. Attendance, Age, and Accessibility

Students are encouraged to arrive 10 minutes early. The Studio is not required to repeat instruction, extend class time, or provide a makeup because of a late arrival or absence.

Students should not attend while experiencing symptoms of a contagious illness. Transfers or credits due to illness are not guaranteed.

Unless otherwise stated, workshops are intended for participants age 16 and older. Participants under 18 require permission from a parent or legal guardian.

Participants requesting a reasonable accommodation should contact the Studio as early as possible.

9. Medical Emergencies

If a participant is unable to act during an injury or medical emergency, the participant authorizes Studio staff to contact emergency services when reasonably necessary.

The participant is responsible for any resulting ambulance, medical, or hospital expenses. The Studio cannot guarantee that medically trained personnel will be present.

10. Photography, Artwork, and Instructional Materials

The Studio may photograph or record workshops, events, exhibitions, and artwork for educational or promotional purposes. Participants may opt out of identifiable photography at any time by notifying the Studio. Parent or guardian permission is required before the Studio knowingly uses an identifiable image of a minor for promotional purposes.

Students retain ownership of their artwork. The Studio retains ownership of its lesson plans, demonstrations, handouts, videos, workshop formats, branding, and instructional materials. These materials may not be recorded, copied, distributed, resold, or used to teach a commercial class without written permission.

Permission is required before photographing or recording an instructor, another participant, or another participant’s artwork.

11. Assumption of Risk and Liability Release

Studio activities may occur at the Studio or at off-site locations, including museums, galleries, parks, retreats, and events in Boulder, Denver, and surrounding areas.

Participants voluntarily assume the ordinary risks of Studio and off-site activities, including travel, outdoor conditions, falls, art materials, tools, and the actions of other participants or third parties.

Carpooling is voluntary. Drivers are independent participants, and the Studio does not inspect vehicles or verify drivers, insurance, or driving records. Anyone choosing to drive or ride with another participant does so at their own discretion and risk.

To the fullest extent permitted by Colorado law, participants release and hold harmless Lael Gallery & Studios and its owners, instructors, employees, contractors, volunteers, and agents from claims arising from these inherent risks, voluntary transportation arrangements, or the participant’s own conduct.

This release does not apply to gross negligence, reckless misconduct, intentional wrongdoing, or liability that cannot legally be waived. Additional venue rules or waivers may apply.

12. Privacy and Communications

The Studio and its service providers, including Ticket Tailor and the applicable payment processor, may collect information needed to process purchases, administer programs, communicate changes, and promote safety.

Payment-card information must be submitted through the authorized payment processor and should not be sent directly to the Studio by email.

Registration authorizes necessary communications concerning purchases, schedules, closures, safety, and Studio policies. Marketing communications will include an unsubscribe option where required.

13. General Legal Terms

These Terms are governed by Colorado law. Any legal proceeding must be brought in a court with jurisdiction in Boulder County, Colorado, unless applicable law requires otherwise.

If any provision is found invalid or unenforceable, the remaining provisions remain effective.

These Terms, together with the applicable checkout page, program description, membership description, and any activity-specific waiver, form the agreement between the participant and the Studio. The specific program or checkout description controls if it conflicts with these general Terms.

The Studio may update these Terms prospectively by posting the revised version on its website or providing other reasonable notice.

Checking an acceptance box, signing electronically, completing checkout, or participating after receiving these Terms constitutes acceptance.
